I filed (pro se) a Petition for Support Unconnected with Dissolution of Marriage without Minor Children...This case is still pending. I also filed a Motion For Temporary Support. We went to mediation and an amount for temporary support was agreed on. As for the Petition ...how do I proceed? He filed an answer contesting the petition. Do I request discovery now? File a Notice of Hearing? Please help get me in the right direction as to what to do first ASAP. Thank you

I would file a notice of hearing so a judge can see why he is contesting it. Then it will be up to the judge if you are awarded $$ or not

You are right

I called the judicial assistant and that's what she said to do, also. In the meantime should I do Request for Discovery? Or wait untl I hear from the Judges office? I appreciate your time, thanks for the input!

Continuing pro se is not the best idea

I know you are already hurting for money but doing this pro se with very little knowledge is not a good thing. Get an attorney.

Petition for Support Unconnected with Dissolution of Marriage without Minor Children? If I understand what you are doing it is a palimony suit. You are not married to this person, you have no minor children with this person, and yet you are seeking support? Thats a very large hill to climb. If that is what you are doing, you will NOT be able to do that without an attorney if you don't know when and how to file discovery. I'm not being mean.

If you want to give more details, we can give you a better answer.

We are married.

I apologize...I was vauge. We are married and have been for 31 years, our children are grown and we have been self employed for the last 17 years. I filed the petition because we are only seperated and I needed financial help and he refused. I had not considered divorce an option but it does appear that may be something I will do...I've been struggling with ending the marriage. EVERYTHING we own is in my husbands name with the exceptiion of the mortgage that houses our business and that asset disquailifies me for any type of legal aid assistance and I just do not have the funds for an attorney. I felt seeking spousal support would be relatively easy...he has the means to help me and I need help...a divorce would be nother matter though because of the business and other assets. I filed a Notice for Trial and believe the next step would be a Request for Discovery, which I am preparing just to prove his income and expenses from the business. I am going to seek a consultation with an attorney and see how I would proceed with divorce at this point. It's all very confusing, I know. There has been alot of physical and emotional abuse throughout the marriage and he is so hostile with me now that I may just have to accept the fact that the marriage is over and proceed from there. Thank you for the time you take with this confusing situation...I appreciate any input you may have.
