I had been employed by a large corporation that paid to relocate me to another city. I signed an agreement that i would reimburse a percentage of the cost of the move if I left the company prior to 12 months service. My business unit was to be sold and close on November 15. I resigned from the company effective November 28. The closing was delayed and therefore I was resigning from the corporation and not the new company.
My final paycheck was withheld and then I was contacted that I would receive a small portion of my check but it would not be sent until December 5. I have my mortgage automatically deducted from my account and now do not have funds to cover it. Is it legal to withhold the majority of my pay and not send this amount until 5 days after the due date?
