I filed a claim with the EEOC in early September. I have not gotten any response. I have tried to contact the investigator since October and the regional office keeps telling me that he is out and they do not know when he will be back. I have mediation for a worker compensation case and they want a global settlement, but I cannot get any info from the EEOC. Any suggestions?
 
Yes - keep waiting.

I'm serious. It is by no means unusual for the EEOC to take up to 6 months or longer for a response.

Can you explain how your EEOC claim and a workers compensation case are connected?
 
I tried to go back to work light duty (help with occasional lifting) and when they terminated my I filed with the EEOC for disability and for sex since there was a male employee receiving help last summer. I finally spoke with the investigator's supervisor and she is going to investigate....more waiting.
 
It is not uncommon for a disgruntled former employee to file charges with the EEOC when a WC claim doesn't go their way. In the more than decade I have handled such claims, not once was the EEO claim found to be with merit, but it is not beyond the realm of possibilities that one might be. Typically this remains the domain of WC. Settling a claim does not impact your ability to report or continue with your EEOC claim. Depending upon how it is written and what you agree to as part of the settlement, you may be restricted in personally collecting monetary damages as essentially, the settlement already provides for that. That does not mean the EEOC won't still investigate if they find merit. If you don't wish to settle, don't settle.

You have two separate actions.
I suggest you retain a workers compensation attorney to guide you through that issue.

As far as the EEOC, it was never fast.
Today it is even slower.
The EEOC works no magic, and often if you have a claim, many say that they were better off retaining an attorney to represent their interests.
Only YOU can decide what is best for you.

An employer is not required to offer light duty. One situation a year ago does not comprise sex discrimination. That also likely explains why the investigator deems it an insignificant priority.
 
I have been squeaking! I have a W comp attny who has lost everything, so we are now in mediation. I have filed with the EEOC for disability and with the NLRB cuz the union has deserved it for a long time. I was a steward and got all kinds of harassment for it. The NLRB had their mind made up before even talking to me. The investigator wrote out a damning statement for me to sign and then pulled out papers for me to sign to drop the charges. This has gone on too long. I am gonna settle. Thanks for all of your help!
