I work for a large CO. and was told half way through a 6-month pay period (commissionable), that because I had OVERACHIEVED by such a dramatic amount (500+%), they had to review my quota and attainment. The company policy states that they will review all overachievement over 200% - and may adjust accordingly. The amount reduced to me in commissions because of this policy will exceed $200K. I am told that the overpaying of commissions is always monitored. As mine was, and more than reduced by half. Do I have any recourse whatsoever, or am I screwed? Forgive the language. I find it unfair that they can indiscriminantly make changes when someone does well for the company - thus demotivating its people. Thank you very much. D2

Although there is nothing illegal about reducing commissions at any time, as as you have posted, anything over 200% will be reviewed and may be adjusted accordingly (unless there is a clause on a signed contract between you and the company saying otherwise), they can do whatever they feel it is best for their business and commission expense. Nothing indiscriminatory here. You should try to have your company negotiate the 300% difference with you since you have proven to be a productive and successful employee. Hope this helps!
