I miss my kids!

My ex and I have joint custody of our two children,11 and 13. My ex has custody of our children when he is in town.(he lives out of state due to job)And I have custody when he is not in town.This is how it states in the divorce decree.But now,ex has had custody of children for 3 1/2 months now and says he is currently not working because of a so called injury at work,so he says he has ran out of sick leave and receives no money therefore I am receiving no child support and am trying to get my children back with me.There is a glitch in the decree about the visitation,so my ex is taking advantage of it thinking he can have custody of the kids at all times when he is in town when we should be sharing custody every other week.On top of that,my childrens' minds have been poisoned by him and they are not speaking with me.I have tried contacting them and they fail to answer.My question is, can my ex use all this time he has had the kids to get full custody and also to not pay child support for the time he has had them?

Leaving out personal information, please post the exact wording of your decree regarding custody and visitation.
 
We both have joint custody."The Court finds that the parties agree and IT IS THEREFORE ORDERED that he shall have possession of the children when he visits them in ...,Texas." "I shall have the right of possession at all other times not specifically designated in this Possession Order for him."(the ex)It also states..."Possession Order until he moves back to ...,Texas.Also,"he shall have possession of the children for alternating weeks beginning on the first Friday after he moves back to ...,Texas and ending on the following Friday." So, anyways,law enforcement has told me I should go by this week to week basis now since he has been here for awhile and is practically living here.

Yes, you should. You should also head back to court for contempt of the court order, and you better do it quickly.
