How is support decided when unemployed?

My jurisdiction is: MI and NY

I reside in MI and pay support to NY. I recently lost my job and am currently receiving unemployment. I also work as an independent contractor w/ an online company which issues a 1099 at the end of the year. I petitioned the court for a reduction b/c my income is substantially lower. Our first appearance was today (mine via phone). My ex is retaining a lawyer so we were rescheduled for 3/16/09. My question is this: besides looking at past tax statements, W-2's, etc, how are they going to prove my income and decide what to use as my income? The only sure money is the unemployment, until that runs out. How can hiring an attorney help the ex out? My income is what it is.

Any input would be greatly appreciated.
 
Hi,

I'm afraid that part time job is going to throw a wrench in lowering your modification.

Also, that lawyer, along with CSEA, is probably researching your bank accounts, and other assets, along with revenue streams.

If CSEA was unaware of your 2nd income and you did not reported it. Look for your support mod to be 0 - 10%

I had identical situation with NY and I live in Ohio.
