I have been married 22yrs,3 children ages 21,16 and 8.Married in NY,kids all born in NY.Husbands business also in NY.Moved back to australia 4 years ago and he has continued to keep the business running there and commute to australia.Found out 2 months ago he has been having a relationship for the past 3 years(also in NY).So income from there but property assets here!He wants to end marriage. Where should this legally take place?Australia or new york? Having given up any career in order to raise family i need to know where i will be best taken care of-please i need to know!

Since you live in Australia, you'll have to file there. You no longer meet the residency requirements to file in New York.

Let me amend my first answer... If your husband has kept a residence in NY, then he would be able to file in NY.

Unfortunately, I know nothing about Australian divorce. Sorry.
