I have been married to my husband for over 2 years, together nearly 6 years. We moved to Colorado from California back in 2004, and took my husband's daughter, who is now 13, with us. My husband has primary custody of her, and she now wants to go to live in California to be with her mother. Her mother has never paid a dime in child support in 4 1/2 years, and wants to collect child support from my husband if their daughter goes to live with her. My question is, why should he have to pay child support if she wants her to live with her, when she never paid us anything for her to live here? Do we even have a case here, or are we just out of luck?

did your husband actually file for child support? Is there an open order?
