Medical Malpractice Gallbladder Surgical Error

Gallbladder surgery was done about three years ago, however, found error with the surgery done just today.

problem is, after the surgeon had removed the staples from the surgery, she had left remaining pieces of staples within the patients body in which over time had traveled away from the original place of origin.

patient had been in pain nearly three weeks now and had sought medical attention 5 to 6 days ago. Patient is suffering lower back pain shooting down to the legs. initial medical attention diagnosed patient with a ruptured hip and a 'small cancer' nearing the end of patients spinal cord. physician gave patient pain reliever for the visit and advised to see another physician during regular work hours.

2nd consultation with physician from another clinic had once again performed an x ray on patient and found several pieces of staples scattered within patient upper abdominal area and slight separation of bones surrounding patients spinal cord. physician requests patient to come back to the clinic tomorrow for a well prepared blood testing (fasting) prior to final confirmation of necessary procedure.

patient can barely walk, sit comfortably, sleep well nor is she able to take care of her family like she used to.

this is not something new that has happened with the hospital in our area, several people have died just seeking medical attention here. recently 2 18 year old's died, one for cold and congestion and the other for a tonsil removal. please advise if this is a potential case that perhaps may awaken the medical world in our area.... :(

Going by the information given in your post, I would have to say the patient very much has a case against the healthcare provider for Medical Malpractice.

You did not mention your state (jurisdiction) but the statute of limitation for bringing a medical malpractice lawsuit is normally three years after the actual date of the injury or one year after plaintiff discovers or should have discovered the injury. There is an exception to the malpractice statute of limitations and that is in this case in which a foreign object was left in the patient. The statute of limitation in such cases is three years which does not begin to run (accruing) until the person discovers, or should have discovered the object.
