I've been employed for 3 years with a Mortgage company in Missouri. In January they attempted to claim I was an "owner" and drew up documents stating that I was purchasing 2% of the company. I did not sign anything nor did I pay any money.
Recently I was terminated and my final paycheck is being withheld until I sign a non-solicitation agreement as well as a document stating that I was a 2% owner. (They are trying to avoid payroll taxes and paying the ADP administrative fees).
They are saying since I was 100% commission I'm not due any money but they will compensate me if I sign the documents --- just so happens the "compensation" is the exact dollar figure of what my commissions should be.
It will also help to know that I typically receive a draw on the 30th of the month and settle up on the 15th of the month for the previous months funded loans. I was terminated on the June 30th so I was employed the entire month of June and would typically be paid on all of those loans --- so to recap the last check I received was June 15th for May 1-30th closings --- I have since worked entire month of June and am due commissions
