I work for the federal aviation administration. I washed out of the training program at my air traffic control radar facility(level 11). There has been a rule in place since June 2006 that states that a person that doesn't fully qualify at a Level 11 radar facility must pick a (level 9 or below) tower facility that doesn't provide radar services. We have have had at least 3 or more people in the same shoes as me get sent to facilities that didn't meet the above criteria and this was after the rule was in effect. Now they are deciding to enforce this rule on me although they haven't previously enforced it on anyone else before. Is there a legal term that would refer to this situation and should I be given the same options as the people before me regardless of this rule becauce they have chosen to ignore the rule in the past? They are now deciding to do things by the book although this rule has been effect for almost 2 years. Thank you.
