Employer not providing W2

Hi ...

I was paid through direct deposits for period Jan-March 07 by my old employer, he says he is not going to provide me W2 for 2007, as he didn't file my taxes, so what can I do now ? I don't have W2, for that period besides he is planning to keep that tax withheld amount, in his pocket which is close to 6000$.

What are the legal ways of going about this ?

Legally he has not done anything wrong - yet - with regards to the W-2. He is also in the clear - so far - with the tax, assuming that it's all for Q4. If it's for anything further back than that, though, he's in violation on that score.

He has until January 31 to provide your W-2. Saying that he will not do so does not violate the law. If he actually follows through and does not provide it, THAT is a violation.

The IRS generally will not take any complaints about W-2's not received until February 15. If you have not received it by then, you can file a complaint with them. They are also the ones with whom you would take up the matter of the unpaid tax.
