Do I have to remain in this state?

My husband and I are currently separated. We plan to get divorced however he stated that he would file the paperwork and has failed to do so as of this time, so we are still married. I am also eight months pregnant and he has made several threats that he would get full custody and that he was going to take the baby away from me. I currently reside in Tennessee and have grandparents that live in Pennsylvania that are elderly, sick and in need of care. Can my husband do anything to keep me from moving out of state?
 
Not really. Besides divorcing you, he can file for full custody of your children but you can always try to negotiate for joint custody. Get yourself a good divorce lawyer so you can protect your rights as a parent and as a soon to be former partner. Good Luck!
 
Dad can certainly fight you. You really should see an attorney. If you can prove the move is in the childs best interest you might be able to move. Dad though is entitled to visitation and you ,ay be required to provide transportation to visits. Until you meet the jurisdiction requiements in PA, Dad can file for divorce in TN which would put you at a disadvantage. You will have to travel to TN for all hearings. Dad can certainly ask for custody, who knows if he will get it. You really should talk to an attoreny in TN.
