i have a friend that was married last february. His wife had a baby nine months ago. He just found out in june that she had been cheating on him since she was nine months pregnant. they got married in vegas. my question is, do they have to get a divorce in california or vegas? when he files he can file for infedelity, right? does he have a good chance of getting their kids(2)?

He needs to get a divorce in whatever state they reside.

He definitely needs to see an attorrney. Also is he sure this child is his? It might be too late to contest patenrity anyways.

I believe CA or NV are no fault states anyways, so he would not get custody just because of infidelity. In fact it is very hard for a father to get custody unless he can prove the mother totally unfit.

He can ask for joint custody and as much visitation as he wants but it is VERY hard for fathers to get custody of infants.
