Daughter taken and father is denied contact

My girlfriend & I have a 16 mo. daughter. She left me New Year's Eve with baby. 2 days later she brought baby back & left her with me. Everything was okay, until Wed. Jan. 20 when she showed up with police & took her with no explanation from her or cops. She refused to let me sign birth cert., but the baby has been living with me at my parent's until now. I aam currently unemployed, but actively searching for work. She already had 2 children taken by the state and adopted by her sister which is where she is staying. She lives now in a different county. She won't answer my phone calls and I am scared to go to her sister's. How should I proceed and do I have any rights since I am not on birth cert.? I have limited funds right now and I don't know what I should do first. Thanks for your time.
 
Your much better off trying to do this with the help of a lawyer. That being said right now you have no rights! You are currently not the childs legal Father and hench have no rights even though child was placed in your care at one time. You need to go to court and get a paternity test ordered. You should do this now before Mom leaves with child anywhere! You want local jurisdiction. Once paternity is established you and her both can seek visitation, custody and, support orders
 
Is there a chance that I could get temporary custody, given the fact that she has 2 children that were taken by the state? Also, if what she told me is true, she is violating a court order of "no contact" by staying in the house where those 2 children are now. Thank you for your reply.
 
No - because you have no standing to petition for custody.


You are a legal stranger (this means you have no more rights to the child/dren than I, or anyone else).

You need to file to establish paternity first, and then go from there.
 
Anyone can 'narc' on anyone they choose. If she's breaking the law or violating a court order, I'm certain the court or child services would be willing to listen.

Your jumping the gun here. Your first action needs to be to establish paternity! If and when you are established as legal Father then you can pursue custody if you wish

I'm not so certain - the standard of parenting is remarkably (and worryingly) low. :( Family court certainly won't listen unless Mom in repeatedly in contempt, and child services will allow her to be a fairly crappy parent before they'll intervene.

Perhaps more importantly, nothing will be done - at all - without PROOF that she's doing something wrong. Not allegations, not maybes, not what-ifs. But proof.

Was this child conceived before or after her other children were removed from her custody?
