I have a friend that just recently (in the last month) went through mediation for child custody. His lawyer was there. The court had appointed an at litem for his 9 year old son and she was also there. Apparnently the mediator who is not a lawyer and the at litem told my friend that if he didn't give his ex what she wanted the judge in Williamson county would make thier son a ward of the state for 6 months. The at litem told him that she would recomend this. So, my friend who happens to be a GREAT dad didn't want his son in state custody so he signed the mediation papers. His lawyer did nothing!! This man went from seeing his son everyday after school to seeing him only on Mondays and every other weekend. His son now has to go to daycare and the ex (who only has a 7th grade education) is having her new boyfriend pick the child up and help him with his homework. She even told my friend she would rather have another man be a part of thier son's life and not him. I am a mother and grandmother and have ALWAYS been in the opinion that a child should be with the mother. However, in this case I don't think so. This poor child has been forced to lie to his father and cries when he told to do so. CPS has been called on the mother 3 times. She convinced people that the dad called on her. He swears he did not. The child even told me that she leaves him alone for long periods of time at night while she goes to visit her friend Shawn (aka boyfriend). I am confused as to why this lady is being allowed to raise this child. The child has even said he wants to live with his dad. I guess the question is, since my friend feels he was bullied into signing the mediation papers is there ANY thing he can do to have them ammended?
He just wants to pick his son up from school everyday and help him with his homework and then have him every other weekend. The ex was willing to let this child go into state custody so as not to have this happen. I'm just confused. Please, any feed back would help.

Something's not right here. Why would the child become a ward of the state? The father doesn't have to agree with the mother's demands in order for the judge to rule in her favor. Why in the world would a judge make the child a ward of the state?

I think your friend needs to post here. This story doesn't make any sense to me, so I have no idea how to respond helpfully.
