My fiance is owed 7948.00 in child support arrears by the mother of his kids. She has been avoiding paying her support and working due to a car accident she was in and was injured. She admitted to my fiance that she changed the dates that her doctor was verifying her disabled by covering the original date and copying the document so she could have a blank space to fill her own date in and then proceeded to copy the Dr's signature onto the new form. otherwise she would have been required to return to work and start paying her support. This form was submitted to the family court of delaware in regards to her contempt hearing for non-support. What kind of legal trouble can she get into for this? I notified the deputy attorney general today. Thanks
 
This is something she admitted to doing thinking my fiance wouldnt report her. Her boyfriend at the time also verified he knew she did this. Of course people can lie, so it will have to be checked out. This morning, we informed the deputy attorney general of Delaware who is overseeing this support case. Do you have any idea how this will be looked into? Also what kind of legal trouble is she facing if this is found to be true?

Ok not to be rude. Whatever penalty the other parent faces or doesn't isn't the issue. The concern should be the welfare of the child not how to see other parent punished.
 
well the children are in the care of their father and i and have been for the past four years. he has primary physical custody and she hasnt exercised her visitation or helped support them in four years so yes i would like to see her in jail. any man who was behind 8000 would have been in prison a long time ago. she is a liar, drug addict, and crimianl, so yes she belongs in prison. i can assure you they are fine and well taken care of by us. yes i am bitter towards her for not caring for them and repeatedly disappointing them so yes i do want to see her go to jail. she should for the simple fact of being behind 8 grand in support and has only ever paid 300.00 in the 4 years their father has had custody. Not to mention our daughter is in counseling because of what her mother has put her through. so i am well aware that the children come first. i have been supporting them financially and emotionally for four years while their mother does absolutely nothing.
 
Then ask a Lawyer! You need to worry about the child not Mom!! Listen I have been there! My EX was an abusive lady and yes my three children went to therapy as well. Yes at first I wanted my Ex to go to jail etc. I spent WAY TOO much time trying to get her in trouble for lack of support, welfare fraud, insurance fraud you name it. I spent hours on phone or emails with AIG etc all for what? I can tell you what to satisfy my revenge! I had children and custody she was not visiting nor calling them. She seldom kept a job so I wasn't getting support nor would I without her having an income. In mean time my children needed me. Was I there? yes but not as much or as focused as I should have been. They are all doing well now but might not had if I continued my pursuit to hurt EX. By the way children have step Mom like you who cares and treats them like her own. She too wanted to see EX suffer until I told her we had already won. In fact my children all plan to seek "adult adoption" (they are adults now) so my wife (their step Mom) can be their legal Mother. So get off getting even with Mom and don't let anger rule you. go give this child a hug and tell child how much love you have. Don't worry about Mom her day will come whether you see it or not.

Think about your question. How would uninvolved anonymous strangers know what punishment another stranger will receive or not?

You know more about this nonsense than any of us do. Besides, I doubt she'll admit to changing, altering, or defrauding anyone. In fact, she may never have said any such thing. Maybe your "boo" is lying?

You reported the allegation, wait until she discovers who dimed her out to the "man". If she's only half as rotten as you say, better watch your back so her rotten pals don't come calling.

If the "man" can do her, she'll get done. Otherwise, she'll go free, if she simply plays dumb.

Once the dime is dropped, the cheese eaten, it gets very nasty with all the back and forth, the lies and the truths.

this forum is called "thelaw.com" I assumed that legal professionals were giving opinions on here. What is the point if all it is "uninvolved anonymous strangers "? Anyway it doesnt matter if she admits anything. All the attorney general has to do is go back to the Doctor who wrote the note that was altered and verify what he/she wrote. All doctors keep charts on their patients especially in pain clinics. ITs not hard to find out. My fiance is not a liar so i dont appreciate that accusation. He is a young father who stepped up to the plate to care for his two young children when the mother didnt care to. There aren t alot of upstanding men these days who are willing so I have much love and respect for him. I just know that alot of damage has been done to these children by their egg donor. Alot of broken promises which hurts kids more than anything. I am mad because no man would ever get away with oweing this much child support and not go to jail. since she is a woman, i guess she is getting away with it. and i am not worried about her retaliation. i could care less.

All criminal defendants are innocent until proven guilty before a court of law. Being charged with any crime doesn't mean you did that crime. Even if one did a crime,it must be proven, not just accused.

You seem to think women who don't take care of their children get a break. Deadbeats come in both genders, and a rainbow of colors. The law endeavors to treat all equally, women, men, children, whites, browns, yellows, reds, mixed, and blacks.

As I said, inquire of the authorities in your state as to what penalties, if any the woman may face.
Most first time offenders get probation, or a slap on the wrist. We are a nation of many chances.

One thing I do know, if the deadbeat mama does go to prison, someone will still be in arrears in 5 or 10 years when she might get out. The kids will be adults by then, and two other people still won't get a dollar of that back child support.

The only victim(s) I see in this disgusting saga are those dear little children.
 
these children are not suffering as long as they are with us. they have not gone without, they have not been exposed to anything bad nor will they be as long as we can keep them safe. and as far as arrears we are getting that money in a lump sum which will be garnished from her accident settlement per attorney general. i dont think anyone understands that this is not just a typical child support case. the states attorney generals office has taken over this case and has it red flagged. they have done a good job keeping us informed and staying in contact with us. however i just informed the office by emai this morning about her altering of documents. of course today is a holiday and they are not in office. i was just inquiring to see if anyone knew anything of this type of situation. i guess its best for us to wait on the DAG response.

But here's the really fun part.

There is absolutely no guarantee that Mom will get more than a slap on the wrist.

And no, the AG can't go straight to the physician. Tiny little thing called "HIPAA".
 
It appears that Step Mom is more focused on seeing Bio Mom punished for issues she has concerns over. As I stated I already know this can cause more harm than good and the likihood Bio Mom will get what Step Mom feels she deserves is pretty low. I can say in my case Mom saw NO PUNISHMENT and eventually found a way to not pay ANY support. Fortunately I saw my error early enough it did not cause serious harm to my children.

I have a couple of questions, actually. If you're claiming that a settlement will be garnished, what exactly is your issue here? Was it simply to badmouth Mom?

Now. About Delaware, and child support. You see, there are Very Important Legal Steps which must be completed before the State can step in and grab oodles of dollars. I suspect that you're really not sure how it all works. But here you go - something for you to read:

As you can see, it's not quite as simple as you'd like it to be.

I wouldn't count on a large sum of money just yet. In fact...I wouldn't count on it, period. Those pesky exemptions always manage to muck things up, don't they? Specially when it concerns lump sums, percentages and Mom's actual financial status. Fun stuff!

Considering OP is not STEP-anything until she marries Dad, I'd say y'all have been awfully nice to provide her with information.... (And of course, marrying Dad does not endow her with any particular rights to someone else's children.)

Dear boyzgrrl, let me just tell you that it doesnt matter what your opinion is on whether I am legally step mom yet or whether I have legal rights. The fact of the matter is these kids already live with me and have for four years and I am the one who feeds them, clothes them, keeps a roof over their heads, picks them up from school when they are sick, attends their school parties, attends the the parent/teacher conferences, signs their report cards, puts them to bed, and gives them love and affection. So i am in every sense of the word their mother. doesnt matter what legal rights i have. im already raising them. get your facts straight before you speak.
