So just wondering if anybody knows if a father can fight for the child to have his last name...A father that just decided to get off drugs and come around that is...
 
Well congratulations to the father. It's not easy to be wrong and come around. Does the Mother want him to be able to change the name? I take it the answer is no because you are saying he would have to fight.
 
The answer is no. I would like him to have my name just as much as he would like him to have his. And yes it is a good thing. But I would still like him to have my name.
 
I suppose there is no chance of the two of you getting married. I don't think a Judge will change a child's name over one of the parent's wishes.
 
Actually it is totally up to the judge. The father can ask, it is up to the court. The court may order the childs name be hyphenated, which happened in my step-daughters case but I am in AZ.
 
My step daughter just took baby's dad to court for child support and visitation. He had not seen the child at all up until court. The child is now 11 months and Dad just started with supervised visits. The father did ask that the name be hyphenated, judge agreed. What is also surprisng is that the judge also gave him 2 years in a row to claim the child on taxes. Up untik now he hasnt paud anything since paternity was never established. He will pay a reasonable amount of support and arrears. This surprised me. The judge was fair though, since both parents work part time and go to school, he used their part time incomes.
 
He get's to claim 2 years?? Wow.
Mothers who recieve child support still have to support the child financially as well. I really don't see how thats fair.

I have a question can you get legitimated as the father before paternity is estalished, or paying child support?
 
Yes by signing the birth paperwork at the hospital. If that is not done then in most cases a DNA test usually must be done.
