Child Support in California.

I have a two year old son who has problems with asthma. Now my Ex-Wife has had good insurance through her work she has sutter gould. She is quitting her job to go back to school. she loses insurance for herself and our son. she wants me to get insurance and she will have nothing. Now my question is that fair or legal? I have been paying half of his insurance that she has, can she not pay half? and another note she will have a pt job mon-fri. 1pm-5pm. Her school starts 5pm-10pm Mon-fri. she wants me to take care of him or my parents. should I take her back to court for 50% custody or full custody. I beleive in working together for our son but she is making it very hard for me. I know is should take her back to court, but dont want to make matter worse than it already is?

Never make any informal agreements when you have open child support custody case.

Always go to court and get everything you agree to (or change) in writing and ordered by the judge, before making any changes.

Never do anything under the table, or just to be accommodating.

You will always get screwed.

Your child will get hurt, too.

There is a very good reason you are where you are today, never forget what brought you here.

That said, take her to court immediately.

Yes, I know its time consuming and costly, but so is teh alternative.

She is responsible for supporting the child, too.

The next thing she'll do is try and get MORE support from you to offset her school choice.

That is HER problem, not yours.

The court needs to know.

Get an order for everything.

The health care is her responsibility.

She won't get a replacement and will use the money you use for other things.

The child will get sick, and guess what?

Get the kid on your health plan.

That way, you know there will be health insurance.
 
If you have insurance obviously you should put your son on yours. Let mom know you will petition for a credit for child support since you will be carrying the child and she still needs to pay 50% out of pocket. Mom does not get out oif financial obligations so she can work part time. Your employer should add the child as this is technically considered a life change. I think you need to google your state child support guidelines and if there is a parenting time discount, you may be paying less support or even file to have it waived. If you and your parents are going to have the child this often, you probably should file to end child support,
