That document you're holding is meaningless.
It also attaches no legal authority, because mom can't sign away what the court bestowed upon her.

The standard for parenting was never that high, and seems to have fallen over the years.
Mom does have the court order supporting her position.
Dad, could have fought that during the divorce.
If dad wants custody now, he'll have to convince the court of many things.

We don't know why, mom couldn't help the child with school work.
We do know that one doesn't need to hold a Ph.D to be a parent, or possess an IQ of a genius.
Just as being poor isn't a crime, being ignorant, or even illiterate isn't either.
I'm not saying I agree with this, but it's the law.

If you're aware of child neglect, abuse, or maltreatment; report it to child protective services or the police.
Otherwise, you should return the child to the mother.
You can't transfer human beings (that includes children) lik you would a car title or an AKC puppy.

Who is writting this? I get a feeling it may not be the father. If that's the case, the chances of faining custody over the child's pae wants is slim.

What army judge is hinting at is that to unravel this mess, the father will have to take the mother back to court. Unfortunately, the bourden to change custody is usually a significant change in circumnstances and the best interest of the child. Each state defines these differently. You could use google scholar and seaech old cases in your state and/or google the family law code of law to leaen aboit the criteria. Also, many family law attorneys will grant free first time consultations. You could interview a few and get a feeling for your case.

One thing the father can do, if he has the rights, is to become active in the child's life. Visit the school. Get to know the teschers. Become an advicate of their child.
