I have an 8yr old daughter who I was seeing every other weekend per verbal agreement I had with the mom. We've never been to court to settle this legally and we've had a couple problems during the year where she wouldn't hold her end of the bargain and would deny or simply not respond to my calls when it was time for me to pick up my daughter. At the end of last year it was my weekend to see her and again she just didn't return my calls and when she did..she simply said I couldn't pick her up eventhough it was my weekend to have her. I haven't talked to her since xmas 09.. is it better to take her to court now? what kind of documentations will I need to have to be in a better position to have my daughter at least 50/50? am I doing bad(from a legal stand point) by not communicating with my daughter?

Having a court-ordered parenting plan in place is best for all parties involved.

So have you even been legally established as Dad?
 
You absolutely should file for visitation and joint custody. you already know mom is not honoring your agreement so go to court and get visitation set in stone. Has paternity been established?

My babys real fathers names not on her birth ceritiftcert. What do i need to do to get the name off and his name on there?
