Change minor childs last name

My husband is wanting to change his sons last name, the mother has no physical contact, since March of 08, she was supposed to file for visitation in order to see him and she hasn't. It has been over 2 years since she has seen her son. Right now we do not have an address for her or a number so we can send her the name change paperwork, I was just wondering is there any way do get a name change since my husband has sole custody without the mother's signature.
 
Sure, your husband can petition the court for a name change. With no objection from the absent parent, it'll be granted. It may take some extra time, but it can be done. How old is the child? If the child is older than 6 or 7, this might be confusing to the kid. So, you might want to speak to a child psychologist first. Some kids tend to lose their identity with name changes after they learn to read and write. Some do very well, however. Just be sure the kid us okay with it, one way or another!
