How much injury must someone sustain before the duty of care can be established ? This is in relation to the cockbill v Riley case. Judge Bean stated that the type of injury the claimant sustained was unforeseen and severe so the defendant does not owe the claimant a duty of care

Each case is different.

A duty of care isn't necessarily the only element that need be considered in such cases.

Finally, the law continues to evolve, remember that.
