can texas grandmother seek custody of grandchildren?

my daughter n law tested pos for drugs when giving birth to her child. cps came to the hospital and placed the baby in voluntary foster care. i was contacted and asked if i wanted the child, and agreed. the daughter n law voluntarily signed the child to me. she was court mandated to do a 6 mth rehab. she has not been there one month, and the rehab center took a group to a department store to buy toiletries. she made a choice to shoplift, was caught, arrested and thrown out of the rehab center. my question is, will the court/cps allow her to go to another rehabilitation center and continue to give her chances or importantly will the child be able to be placed with me permanently to be adopted? pls. someone with any advice......

Generally, mom will have close to two years to get her act together. Where is your son (he is the bay's father?)?

If you wish to continue as the child's guardian, you should communicate your desires to CPS and the court.

At this point all you can do is hope that mom does not complete the parenting plan. You need to keep in touch with the case worker and let her know that you would like to adopt if mom is proven to be unfit. These cases can grag out but out here in AZ....they have guidelines in place and mom usually has 1 year to get her act together.

Who is the bio father? An attempt is going to have to be made to locate him and he will be asked to likely terminate rights if it gets that far.

Stay on top of this and communicate with the GAL and the worker. Mothers that give birth to drug exposed babies almost NEVER clean up their act good enough to permanently take care of the baby. Chances are she will screw this up.
