how can I move out of state if my kids father has joint custody?
Do I really have to go to court or can I just have a notarized agreement between us that states that hes ok with the move just in case he ever wants to take me to court.

Your husband has no legal authority to give you permission to take your children anywhere. If you want the custody order changed, you'll have to take it before the judge.

If you remove the child(ren) without the court's permission and your husband later gets angry, you'll pay a very big price down the road.
 
Unless your custody states that you have to have court approval, you can move by simply notifying the other party. They then have the option of going to court. If they have agreed, then there is no problem. However, child custody is always modifiable.
