Is there a way to avoid that the Agreement will be binding upon and inure to the benefit of the parties' successors and heirs?
What happen if the Agreement is governed by the law of an American State, the author (he is not a USA citizen and lives outside USA) submits to the personal jurisdiction of that State and a suit or action is instituted there? How can the Author defend himself? How can the federal court act on him in case of any claim?

Complex stuff...........You need to talk to a copyright lawyer. Initial consultation is usually free...........Evaluate your options and go from there.

You can look in your yellow pages or Google copyright lawyer online with your town. You can call a few and visit, then decide based on their profiles which would best serve you if needed. Most lawyers have online sites...........just google phrase with lawyer copyright and town name.
