If a company advertises in a local payper for day and night drivers and no mater what.Makes every new driver employee a night driver. is it illegal to advertise to intice people to apply? is that bait and switch?Because in the interview the boss is offering both positions but the employee is getting no choice after being employed and trained?

No, this is not illegal. If you had a binding employment contract that notes you are to be a day driver, then that could be a different story.

You also have a right to refuse the night shift job if you do not want it. They aren't forcing you to work there.
