back payments on insurance premiums

I have a question about the legalities of this
my place of employment has put me in charge of getting info regarding employees who have not had health insurance premiums taking out of their check on a monthly basis. The company failed to submit paperwork to the paychex company for a certain amount of new hires and now that open enrollment is coming around it has been brought to my attention to backtrack to make the employees back pay what should have been taken out
what are the legalities of this?

Your post is hard to decipher, but it sounds as if there are employees who should have had insurance premiums deducted and did not; you have been put in charge of clearing up the matter.

There is nothing whatsoever illegal about requiring the employees to pay the back premium they should have paid and didn't, regardless of whose error it was that caused the deduction not to be taken.
