Auto body shop help

Last August our car was wrecked & taken to a local body shop that has done good work for us before. Our insurance company had paid him in August & our car is still there & it's 8 months later. At first we'd call or go by the shop to see how it was going & it looked as tho it was being worked on. After 2 months we we're getting tired of waiting & when we questioned what was taking so long, he'd say that he had to order a part or had one excuse or another for not getting it done every time we were there. Since then we have found out that he hasn't been paying his bills & has no credit at the auto parts stores in town. When he answers his phone he says that it's almost done. Even our insurance agent has talked to him! Now it seems that no one can get him on the phone, his shop is locked up & the mail box is stuffed with mail. All we want to do now is just get the car out of his shop & take it somewhere else where it'll get fixed in a timely manner. Can we take our car? If so, how? I live in Oklahoma.

No, you cannot take the car out of his property. That will be considered trespassing. How much is your car worth?
 
Contact the insurance office again and tell them these new developments and ask them what are your options. If they can't help, you may have to sue him and/or contact your police department and file a complaint or report to try and get your car back.
