I want to know if I would be in fault and not win a case, if I built a case. They speak spanish, everyone who cooks food. This is where I am throughout the day. I don't speak spanish nor do I feel that they pay me enough to learn it either. We communicate through hand gestures and some words if (applicable).

Where I see a problem is in the management who are bilingual speaking in spanish amogst themselves. Telling a joke mabe

1. Can I have recording material on me during a shift? Audio and or Video?

2. If they are caught saying something negative about what can I do ?

3. In the end, I want to know how far I can go with this on the low?
 
You have no case. Nothing in the law says that they have to speak English - in fact, the law says that they have to be allowed to speak Spanish.
 
Agree. There are some exceptions where employees can be required to speak English such as for business reasons (ie cooperative work assignments where English only rule is needed) or safety reasons.

However; in your case, you have no case.
