i need legal advice and fast. i have twin daughters and i was never married to their father. we just dated. in 08 i aasked their dad to take care of them until i got back on my feet. i also had him sign a statement that agree to leme getting them back at the end of that school year. he did sign it and so did i and a witness. when the time came he had moved and i was told to not contact the girls at all. i woudnt know their location. still today im having issues with him . he still has the girls. i have the written agreement that he signed and some other stuff that can help my case. recently my son text one of the girls and he text my son back saying he wasent allowed to text his own sisters ever. i need help and i need it quick. please im really need help

Madam, we can't provide you with the type of help you need.

You need to HIRE an attorney.

But, there might b e one other avenue you can pursue.

I'll give you some details, but DO NOT act upon my advice.

Why?

You may make more trouble for yourself in the end.

WAIT, until others chime in on your query and comment on my advice.

Did the "alleged" father ever go to court and get a proper legal custody order in place?

Did the "alleged" father ever establish his paternity (DNA testing)?

Did you ever go to court and establish a proper legal custody order?

Have you gone to court and arranged to pay child support?

You can forget about those gifts you gave them, that money for Pampers, anything except what was paid pursuant to an established court order pf support won't count!

The document you had him sign was very foolish.

The fact that he has kept the children for three years may be your undoing.

He has stability on his side.

Courts are very reluctant to snatch children from a safe, sound, environment.

I'm not going to offer you any advice except you need a lawyer, if you ever want to have a slim chance of seeing those children again!

I'll let the lawyer you HIRE describe any other remedies that may be available to you.

Bottom line, you need to get the lawyer to haul him into court.

And, at this late date, that might not be enough!

I suggest you await the advice dispensed by my colleagues better informed on these matters!
 
I would bet you have an uphill battle getting custody back. You have abandoned your childrens custody for almost 4 years.

That's it, in a nutshell.

This OP has - even with the best attorney - very little chance of obtaining primary custody unless she can show that Dad is either unfit or something significant has changed in the lives of the children. And even then, if she's had no contact for those 3+ years, her chances are even slimmer.
 
Quite honestly he has had the girls for so long..it is going to be very hard to secure custody. Why have you waited over 3 years to do this? Are there any court orders at all? You can certainly file for visitation and possibly joint custody but the chances of you getting custody are slim. A court is not going to uproot the girls 3 years later without a very good reason.
