Hi everyone...
I'm a 24 year old who's trying to adjust his status into that of a legal resident in the US. I was brought here on a tourist visa back in 1993 when I was just 9 years old and we overstayed our visas. I grew up here and think of myself as an American in every way that counts. My family was grandfathered by 245(i) and last year I found a company to sponsor my application for adjustment. Thus far, I have received my labor certificate through the perm process and I submitted I-140, I-485, I-765 work authorization, and I-130 advance parole applications. I was called in to do my biometrics a few weeks ago, and have been told to expect my employment authorization card (EAD) within 2 to 4 weeks. Well 2 weeks ago I was notified that an RFE in the EAD application was issued and they have asked me to prove registration in NSEERS since I'm of Jordanian citizenship. The thing is that I have NEVER heard of NSEERS until that moment and the whole thing is freaking me out. My attorney doesn't know what to do as he's never come across such a case and I need help desperately. In my research I found that the NSEERS registration should have been done in 2003 when I was 19 years old and still a student. Does anybody know what the best response would be for the RFE? And is it probable that my whole application will be denied as a result of failing to comply with that registration request back then even though I didn't know about it? I'm very worried that this will be the end of my presence in the US since I haven't been working for 2 years after graduating with my MS. Thank you.
