Sports Copyrights Permissions and YouTube Channels

Hi all,

Is there any copyrights requirement required to have sports clips featuring NFL-branded teams on a private/personal YouTube channel. A channel such as this one has such clips. If permission to play the team-branded videos is needed how is this permission obtained?

Here are other private/personal channels featuring sports clips from pro-branded teams. Some even feature videos from sports TV shows.

There's a lot of stuff on youtube that infringes on copyright. Some stuff might or might not be fair use. Copyright law is complicated. You should go to the US Copyright Office website and educate yourself as best you can.

How you get consent is you find out who the copyright owners are (not easy) and ask for written consent or buy a license to use the material.

Or, you can hire an intellectual property attorney to advise you if you plan on doing anything for money.

Your question is more complex than you realize. I suggest you research "fair use" as a start.

I don't know what "private/personal . . . channel" or "featured channels" mean, but it likely doesn't matter.

Section 106 of the Copyright Act gives the owner of a copyright "the exclusive right[] to do and to authorize" others to do several things, including reproducing the protected work, preparing derivative works, and to publicly display/perform the works. There are exceptions, and the most well-known is fair use, which is codified in section 107 of the Copyright Act. Whether any given video is an infringing video or, if so, whether fair use (or any other exception) might apply is a case-by-case inquiry that would require viewing the video or at least having all relevant details.

The NFL is hyper-vigilant about protecting its intellectual property, so the way to obtain permission is to contact the NFL. I suggest you review some of these search results, and, particularly, this one.

Yup. And there are a LOT of rights owners who don't mind the infringement. For example, there are tons of note-for-note covers of well-known songs (either an entire band or for a single instrument). Those videos aren't usually fair use, but the rights owners will allow them because it's actually beneficial in some cases. While the NFL is hyper-vigilant about its IP, the sheer number of videos feature NFL game footage suggests to me that the League will tolerate quite a bit of infringement .
