Reselling an item already sold

    If you have paid for an item but have not yet been able to receive/pick-up the item, is it legal for the seller to then resell the item after so much time has passed and not return money to the original buyer? In other words receiving payment twice for the "same exact" item.

    The seller can re-sell it if it's his property. Whether the property reverts to the seller depends on the facts and the agreement between the seller and buyer. Did the item have to be picked up by a certain date? Was the buyer incurring storage charges that eventually amounted to the value of the item? Was it left so long that it could be considered abandoned?
