Name change ?

My girlfriend wants to change her 10yr old son's name to her maiden name.Her son carries her husband's last name(she is separated from him)which is also on his birth certificate.He is not the biological father of her son.Can she do this this without consent from her soon-to-be ex husband.Also,would he have any rights such as visitation,custody,etc.?

The father of the boy has rights; the kid's name cannot be changed without dad's consent.
