A girl 13 year old female student is harassed by by another 13 year old female student. The two students pre-plan a fight after school off campus. The school is aware of the plan and talks to both students. The school says the students stated they had other plans but one student says she stated that she clearly advised the school that the fight was still gong to take place.
The school then decided to notify police of the fight plans and the students involved and in accordance with the student handbook (which states that when police are called for suspet student activity, parents are to be notified)phoned one students parents. They did not however inform the other students parents. The schools stated to that set of parents that they were too busy to notify them. When questioned as to why they were too busy the school stated that they were dealing with an emergency, although one of the parents of that child was in the school central office at the time of the stated emergency speaking with the principal with the student at they're side and was not made aware of the fight plans nor did they obsereve that any emergency exsited. The school day ended and the fight took place,one student was injuried with a broken nose,both girls were subsequently charged with disorderly conduct by police. The schools response was not even handed, the injuried girl was suspended for 3 days, the other girl whose parents were not given notice that the fight was planned has a school board hearing set with a recommendation for permenate expulsion. If they sustain a loss of the students education should they they sue the school for negligence,because they were not notified of the impending fight. Additionally is it a violation of equal protection to suspened one and expel the other when they both planned and particapated in the fight. Also the school claims jurisdiction in this off campus matter because several childern shot video of the fight with camera phones and posted it on a website. The school claims disruption of operations and harm to the general welfare of the school because of the video which they suspect that the student set for expulsion asked the others to shoot. However the school does not know who posted the video nor can they produce the person who shot it.

What do you expect to gain from going to court?

both girls were subsequently charged with disorderly conduct by police.
Apparently punishment has been served.

I would recommend leaving all else alone.
 
It would seem that the school may have been negligent, in their response. The parents of each student should have been afforded the chance to respond before the fight occured which may have prevented the fight with no injuries and no criminal charges.
