Is it possible to cancell the agrement

I Paid $ 60,000 as advance for the purchase of one property amounting $ 9,00,00 in NY. The advance agrement was made on the condition that the property sale should be finalised before 2 months from the date of advance agrement. But due to certain reasons the Seller was not able to get C.O of the building before the date.I gave an additional one month period to the seller for getting the c.o.The period of 3 months already gone. But after 3 months from the date of advance agrement the seller now came with the c.o. But i am not interested in the deal now. Is it possible for me to go out of this deal by getting back my advance amount of $ 60,000 with any other legal benefits.
