if there is no order on custody

can a person deny contact just b/c they want to wait untill divorce or custody hearing is FINAL? friend is gong through hell with wife. she agreed on the phone to him having their son for 2 mos this summer, and told him to type it up and fax it and shed sign...well, she lied, and now shes saying that she absolutely refuses to let him see the child untill she gets custody papers filed...since they are still married and there is NO judgement on the custody or divorce end, can she deny him?

Can she deny him? Techically, but he has just as much right to the children as she does. i would see about getting an emergency hearing to see if dad can be granted some sort of custody or visitation agreement.

unfortunately that won't work...the divorce is in cali, but the custody has to take place in fla...he'd never be able to just come up with the money to file for custody there, and to buy the plane ticket...she(again)now says she will sign for him to get their son during the summer, and that she's filing custody thursday...
