My grandmother passed away in May and her Will says that the house needs to be sold at the end of the year. The trust says my uncle can remain in the house until Dec. 31st. A roommate is living there paying no rent and they know that if they don't move out by then, then a eviction notice will be sent but they used to be a manager at an apartment complex and knows how to extend their stay with dealing with court and eviction notices. If it is in a Will for all persons to be out can they actually stay longer or will a judge grant the eviction even if the roommate counters the eviction? When the roommate moved in they knew that the house was going to be sold and have been talking about staying longer even if they get the notice. HELP! The sooner they are out the sooner we can clean carpets, fix repairs, and paint.
