I recently told my employer that they could not average hours worked over 80 hours in order to avolid paying overtime per week. They then told me that they could give me a 1099 for taking the company truck home. They said it could be considered a bonus of $4000.00. I have always worked for a company that a truck was provided and have never heard of this. Am I wrong?

Are you using the truck for personal business? What state are you in?

Are you an independent contractor? Have a contract with them? Full time employee? Sorry, I should have asked you this earlier.

Back to your posting, you are right - something fishy is going on. Check out the link below to see if you are in the category of those who don't qualify for overtime.

Regarding the truck, I don't agree with the schpill that it is a bonus. Have a sit down with your boss and clarify the issue. You don't use the truck for personal reasons and it is considered a tool for you to perform your work. If he doesn't back down, then consult with a labor/employment attorney. Hope this helps!
