Would Judges rule against mis-filing of custody

My godson is in the midst of a child custody dispute. His mother originally filed for child support even though she didn't pay for any of the childs needs, at that time a court appointed mediator drew up an agreement and it was submitted and signed by a judge. When that agreement wasn't being followed and the mother stated she couldn't afford to feed the child when in her care or pick him up because of the cost of gas the father filed for custody, unbeknownst to him he should have filed an ammendment. Regardless the custody order went before the court and the mother didn't show even though she was served the papers, the judge ruled in the father's favor. During the time he has had custody the mother still doesn't pick up the child during her visitation times. Now the mother has filed for joint custody as a seperate motion (again not an ammendment). As of today there are 3 different suites for the child. Would a judge throw out all the suites and revert to the first one? or hear the case 1st and review the information provided showing proof of the mother's instability?
 
I suspect the judge will consolidate the three matters.

Just a guess...
