I was a Police Officer in SC, I was beat in the head with a
lead pipe, while on a traffic stop. I starting having
severe migraines in which my wife started worrying about.
She told the chief of police to send me to the doctor etc.
I was told I had Post Concussion Sydrome along with
Vertigo, Hearing Loss, and Concentrating problems etc,
along with some other problems. My attorney calls me up and
says they came to an agreement in the case in which it will
be 1 year Sept 23,2004, on my settlement. The award is
lifetime medical, and a lifetime weekly check of $224.28.
They put me out on total disability. Since then I am still
seeing a neuropsycologist, and a neurologist, and on a few
medications for memory etc. I feel and so does my doctors,
like I will be able to return to law enforcement,
eventually. Total lifetime benifits with medical is about
$765,000 I think two hundred and some change is actually
for medications etc, the rest is settlement. My lawyer is
so happy about this settlement he told me that this is by
far the best settlement available in SC. My problem is OK I
want to return to law enforcement, But he says that if I go
to work anywhere the benifits will stop, then I will get
nothing. If it is already court ordered why would it stop?
Or why can't I go back and get at least some of the money
etc? I mean I am the one who got injured here, and it was
pretty bad. Can someone please shed some light on this
situation for me? With kind regards I am,

C Morgan

If it is already court ordered why would it stop? Presumably because the court issued the order based on medical evidence that you are totally disabled and unable to work. If you return to gainful employment at a future date, that obviously changes the picture significantly.

Your attorney needs to be the one explaining these issues and the terms of the settlement agreement to you. If you don't think he's representing you well, then consult with a second attorney.
