Will my children be taken away from me?

I have a one week old baby girl and the father and I are having problems and threatens to take custody of my daughter. I currently have no where to reside other then my mothers home but my mom does drink and smoke and I'm fearful that if he uses that against me, the court will feel its an unsafe enviorment for my daughter. I'm her primary care giver. If he uses that against me will they give my daughter to him instead.

Your mom drinking and smoking won't matter unless Dad - is he even legally established as Dad yet? - can prove that it's harming the baby.
