Who owns the body?

I would think circumstances in this case can pretty much apply to most jurisdictions:

BACKGROUND - - -
An adult man was buried 50 years ago.
He did not have property, and he lived with his sister.
The man had fathered a child, who at the time of his death was 7 years old, and who, of course, did not have the means to pay or contribute to her father's funeral expenses.
Because the man was practically indigent, his sister paid for the funeral expenses and buried him in a grave, part of a private plot she owned.
The sister has children of her own, who inherit their mother's property, including the private plot and the grave where her brother is buried.

50 YEARS LATER - - -
The sister dies.
Her children inherit her property, including the plot and the grave where her brother is buried.

QUESTION - - -
Who owns the remains of the BROTHER buried in his SISTER'S grave?

1 - The heirs who inherited and now own the property?
2- The brother's child, now an adult who had nothing to do with her father's funeral arrangements to begin with?
 
My condolences on this most upsetting episode.
It doesn't matter who owns the remains of the dearly departed five decades ago.
The remains will remain where they were interred, until someone petitions a court to have them disinterred and removed to another burial site.

There's been a story in the news lately about the body of a little girl who died around 145 years ago, and was found buried under a home in San Francisco. The home is built on land where a cemetery used to be, and they had moved all the bodies but apparently missed this one tiny coffin. The homeowner was told that she now owned the body and it would be her responsibility to relocate it.

You seem one of those people that feels unlucky with how the world treats you. When you are as much a jerk as you seem to be, it is what you should expect. This hypothetical is one that, if it hasn't happen before, it will happen to someone. And a searching, curious mind is better off by knowing the options. You obviously have better things to do, yet you find time to peruse irrelevant forums like this one, wasting time NOT answering hypotheticals because what... because you're too busy?
