When is a server entitled to get tips?

Can your employer make a time range and certain requirements that a new server must pass to be in the tip pool? (can you provide documentation) Thanks!

As long as the server is paid at least state minimum wage and overtime if he works over 40 hours in a week, I'm not aware of any law that would prohibit such a requirement.

You need to read the links above for full information on tip laws & OT laws Ca. I might mention though that Ca. pays OT if you work over 8 hrs. in a workday even if you didn't work over 40 hrs. in the workweek.
