We had a technician come to our house to fix our boiler.During the process he came out five times, each time doing something else and charging us for varios parts. On the fifth time when he did not fix the problem we stopped payment on the check. We wanted it fixed before we paid him because at this point he was doing trial and error. He proceeded to put a mechanics lein on us and turn us in to a collection agency to get the money. He had no desire to work it out. He sent us various letters that had false information in it which we can prove and he has gone so far as saying he has talked to other technicans in the area and they say we own money all over town. We don't own anyone any money we pay all our bills. On the mechanics lien the information he put is wrong. The dates are wrong and the parts he had down are not right. We had to have another technican come out to fix our boiler which he did and it had nothing to do with the parts replaced by the first technican. Our current technican has put all our old parts back on and we have the other parts. We told the first technican we would return his parts to him but he wanted nothing to do with that. We want to know what we can do. We don't want to have to spent a lot to go to court but we want the mechanics lein lifted and the debt collection removed since he never even fixed the problem. We just don't know what to do. Pleae help.
 
What you do to remove the lien depends on where you are. Usually you can apply after one year to have the lien removed if the guy hasn't taken any steps to enforce it. If you want to push that timetable ahead, you can send him a notice to commence his action to enforce the lien within a set time and if he fails to do so, you apply to have it removed immediately.
