My dad's mother passed a year ago and he was willed the house, the only assest. However, he is being told he must pay the funeral costs and lawyer fees before it will go through probate. The sister paid all the costs and now is trying to write up a mortgage/loan for my dad to pay with 6% interest. Who is the lawyer of the estate representing? Is it in his interest to get his own lawyer or is this lawyer supposed to be representing him also?
