Can i get in trouble if i use my spouses bank account to pay the rent after he has abandoned his family and he is still on the lease but i am not on his account? he was the only one of us working and paying the bills. we have 2 small children together what all can i file for? and how long will it take?

If you are not on the account how do you intend to access it? You can't. If you have been adbandoned you need to file for divorce and ask for chilkd support. You also might want to get a job or start planning life as a single mom. You cannot depend on your husband if he has left.
