I am being sued by someone who got my name from an "old" friend who says I was the person who hit a fire hydrant and flooded her basement. This person made a verbal statement over the phone the the other persons Lawyer but never signed it. Now the Lawyer has subpoenad (sp) the person who said I was there. That person is now saying he lied and I wasnt there but the lawyer is saying he has to sign it. I was not there, there was no police report, my ins had denied the claim. What can I do? This persons own Atty advised him not to sign the statement as well. Can someone help??
 
Unless and until you've been served and the "witness" has pointed the finger at you, don't worry. If he's willing to perjure himself, then you might have a problem.

You might see if he'll give you a sworn statement now before he changes his mind, in case he does give inconsistent evidence later, so his credibility is shot.
