Vehicles and contents of house and garage

If the car (1985 Dodge) and truck (1988 Dodge) and the contents of the house and garage are not mentioned in my Father`s will and we plan on having an estate auction to sell these items do we have to wait until after the auction for the Lawyer to settle the estate seeing as how they were not in the will? (In NYS)

all parties involed can sell the items and split if everyone agrees to to the sell of the items and split it equally

But can the will be settled up with the lawyer before we do that or does the dividing up of the money from the sale of the contents have to go through the lawyer too?
